1.2 Scope
These Terms apply exclusively to donations made via the Stripe payment link accessible from sentinellesapp.fr. They do not govern the use of the SentinElles mobile application, which is subject to the Terms of Use.
1.3 Acceptance
By proceeding with payment, the donor acknowledges having read, understood and accepted these Terms in full. Clicking the "Donate" button and completing the Stripe transaction constitutes full and unconditional acceptance.
Article 2 — Purpose of the donation
2.1 Use of funds
At the current stage of the project (donation collection and grant application preparation), funds collected are allocated to:
- Development and maintenance of the SentinElles mobile application;
- Secure hosting of data and infrastructure (Cloud Run, Cloud SQL, encrypted backups);
- Support for testers, community moderation and outreach;
- Preparation and follow-up of public and private public-interest grant applications;
- Operating costs of the association (banking fees, Stripe fees, website hosting).
2.2 Future business model
For the sake of transparency, the donor is informed that, starting with the public release of the application (version 1.0.0), the Association plans to supplement its resources by:
- Selling premium features to institutional partners or local authorities (aggregated dashboards, territorial alerts);
- Monetising strictly and irreversibly anonymised data, in accordance with the Privacy Policy — no personal data will ever be sold.
These future revenues will complement, not replace, donations and grants, which remain the cornerstone of funding.
Article 3 — Payment terms
3.1 Payment provider
Payments are processed by Stripe Payments Europe, Limited (hereafter "Stripe"), a regulated payment service provider. The donor is redirected to a secure Stripe-hosted interface (URL donate.stripe.com) to finalise the transaction.
3.2 Amount and currency
The donation amount is freely set by the donor, within the limits offered by the Stripe interface. The reference currency is the euro (EUR). The Association imposes no minimum or maximum, subject to Stripe's technical limits.
3.3 Payment methods
Accepted payment methods are those enabled by Stripe on the donation link: bank cards (Visa, Mastercard, American Express) and, where applicable, electronic wallets (Apple Pay, Google Pay, Link). The exact list may evolve depending on the Stripe configuration.
3.4 Donation confirmation
Once payment is complete, the donor receives a confirmation email from Stripe summarising the transaction (amount, date, reference). This confirmation does not constitute a tax receipt (see Article 5).
Article 4 — No counterpart
A donation is by nature a unilateral gift. In return for the donation, the donor receives no goods, no services, no material benefit from Association SentinElles.
In particular, the donation does not confer any:
- Right of early or exclusive access to the application;
- Right to influence the Association's decisions;
- Copyright or intellectual-property right over content produced by the Association;
- Status as a member or official partner.
The donor may be publicly thanked (newsletter, dedicated page on the website) only with explicit consent, in accordance with the GDPR.
Article 5 — Tax regime
- Your donation does not entitle you to any income-tax, corporate-tax or wealth-tax deduction under French law;
- The Association cannot and will not issue a tax receipt (form CERFA n° 11580*05) for your donation;
- The only available proof is the Stripe payment confirmation sent by email.
Donors seeking a tax deduction are encouraged to direct their giving to associations that hold a French rescrit fiscal or equivalent recognition. As soon as Association SentinElles obtains such recognition, it will update these Terms and inform its donors.
Article 6 — Right of withdrawal
Pursuant to article L.221-2, 2° of the French Consumer Code, the right of withdrawal applicable to distance contracts does not apply to donations, which constitute neither the supply of goods nor the supply of services.
Nevertheless, beyond its legal obligations and as a goodwill gesture, Association SentinElles agrees to refund donations under the conditions set out in Article 7 below.
Article 7 — Refunds
7.1 Principle
Donations are in principle final. The donor cannot demand a refund as of right.
7.2 Goodwill refund
The Association will agree to refund a donation in the following cases:
- Manifest error on the amount (e.g. an extra zero entered by mistake), upon request sent to contact@sentinellesapp.fr within 14 days of the donation date;
- Double charge caused by a technical failure, on simple confirmation;
- Fraudulent donation made without the cardholder's knowledge (in which case using the chargeback procedure with the issuing bank is preferred).
7.3 Procedure
The refund request must be sent by email to contact@sentinellesapp.fr and must include: the name used at the time of the donation, the email used, the approximate date, the amount and the reason. The Association will process the request within a reasonable time (typically 7 business days). When granted, the refund is processed via Stripe to the original payment method. Stripe's transaction fees (typically 1.5% + €0.25 for European cards) remain at the Association's expense.
Article 8 — Payment security
Payments are entirely processed by Stripe, certified PCI-DSS Level 1 (the highest level of card-payment security certification). Specifically:
- Card details are entered on Stripe's infrastructure and are never transmitted to or stored by Association SentinElles;
- The payment channel is end-to-end encrypted (TLS 1.2+);
- Strong customer authentication (3-D Secure 2) is enforced under the EU PSD2 directive when required;
- The Association only receives non-sensitive transaction metadata (Stripe identifier, amount, date, donor email if provided).
Stripe's privacy policy is available at stripe.com/privacy.
Article 9 — Personal data
Processing of the donor's personal data (first name, last name, email, donation amount and date) is governed by the SentinElles Privacy Policy and by Stripe's policy. The main legal bases and purposes are:
- Performance of the donation contract (GDPR Art. 6(1)(b)): processing the payment, sending the confirmation email;
- Legal obligation (GDPR Art. 6(1)(c)): retaining accounting records for the legally required period (10 years, French Commercial Code Art. L.123-22);
- Legitimate interest of the Association (GDPR Art. 6(1)(f)): payment fraud prevention, fundraising statistics.
The donor has the rights of access, rectification, erasure, restriction, portability and objection provided for by the GDPR, exercisable by writing to privacy@sentinellesapp.fr.
Article 10 — Amendments
Association SentinElles reserves the right to amend these Terms at any time to reflect changes in regulation, business model, or technical tools. The Terms applicable to a given donation are those in force on the payment date, available at any time at sentinellesapp.fr/en/donations.
Article 11 — Governing law and disputes
11.1 Governing law
These Terms are governed by French law, in particular the provisions of the Civil Code on liberalities, the Consumer Code, the Monetary and Financial Code, and the law of July 1, 1901.
11.2 Mediation
In the event of a dispute between the donor and the Association, the parties shall first seek an amicable solution before any court action. A consumer donor may, if they wish, refer the matter free of charge to a consumer mediator under article L.612-1 of the French Consumer Code.
11.3 Jurisdiction
Failing an amicable resolution, any dispute relating to the interpretation or performance of these Terms falls within the jurisdiction of the courts within the area of the Paris Court of Appeal.
